Once the interested parties have been formally notified of the resolution issued by the Code of Ethics Administrator, the party that considers itself affected or harmed may appeal in writing to the DSA Board of Directors.
Such appeal must be filed within fifteen (15) calendar days from the date of notification of the resolution, and must clearly and duly set forth the grounds for the appeal, accompanied by the arguments and/or supporting documentation that deems pertinent to submit for the Board’s consideration.
Upon receipt of the appeal, the other party involved shall have ten (10) calendar days to submit its written observations or defense.
Upon expiration of this period, each member of the DSA’s Board of Directors shall receive a full copy of all relevant case documents, including the original resolution of the Code of Ethics Administrator and the documentation submitted by the parties. The directors shall analyze the case individually and independently, evaluating whether the challenged resolution was issued in accordance with the applicable procedures and the provisions and principles contained in the Code of Ethics of the DSA.
Upon completion of the review and deliberation process, the Board of Directors may confirm and ratify the resolution of the Code of Ethics Administrator, or revoke it in whole or in part, issuing in its place the resolution it deems appropriate.
The Board’s decision shall be adopted at the session immediately following the filing of the appeal, shall be communicated in writing to the parties involved, and shall be final and binding, with no further recourse available within the organization.
All information, documents, and materials submitted in the context of this procedure shall be strictly confidential. The Code of Ethics Administrator, the members of the Board of Directors, and any person who becomes aware of such information in the course of their duties shall be obligated to maintain absolute confidentiality with respect to its contents.
